Terms of Service

Please read these Terms of Service ("Terms") carefully before using the careG application ("Service") operated by careG ("we," "us," or "our"). By accessing or using careG, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use careG. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

2. Account Registration

To use careG, you must be invited by an administrator and provided with account credentials. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You agree to notify us immediately at michael@pivit.tech of any unauthorized use of your account.

3. Not a Covered Healthcare Service; No HIPAA Relationship

careG is a personal caregiver coordination tool designed for use by individuals and family members managing care for loved ones. careG is not a healthcare provider, health plan, or healthcare clearinghouse as defined under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), and is not subject to HIPAA's requirements.

Information you enter into careG — including medications, health conditions, doctor contacts, care notes, and related details — is personal information you voluntarily provide about yourself or individuals in your care. This information is not Protected Health Information ("PHI") as defined by HIPAA, and careG does not function as a Business Associate of any covered entity.

careG is not intended to be used as a clinical records system, electronic health record (EHR), or substitute for any healthcare provider's official systems. You should not use careG as the primary or authoritative record of any person's medical care. careG does not provide medical advice, and nothing in the Service constitutes a clinical recommendation or diagnosis.

If you are a healthcare organization, clinic, hospital, or other HIPAA-covered entity and wish to deploy careG for use in connection with patient care, please contact us before doing so. Such use may require a Business Associate Agreement and is subject to our review and approval.

4. Acceptable Use

You agree to use careG only for its intended purpose of coordinating caregiving activities. You agree not to:

• Use the Service for any unlawful purpose
• Upload false, misleading, or harmful information
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials with unauthorized individuals
• Use the Service to harass, abuse, or harm others

5. Health Information Disclaimer

careG is a caregiving coordination tool and is not a medical service. The information stored in careG is for organizational purposes only and does not constitute medical advice. Always consult qualified healthcare professionals for medical decisions. careG is not responsible for any medical decisions made based on information stored in the Service.

6. SMS Messaging

By providing your phone number, you consent to receive SMS notifications from careG via Twilio, including task assignments and reminders. Message and data rates may apply. Message frequency varies. 7. Privacy

Your use of careG is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Data and Content

You retain ownership of all data and content you enter into careG. By using the Service, you grant careG a limited license to store and process your content solely for the purpose of providing the Service to you. You are responsible for the accuracy and legality of the information you enter.

9. Service Availability

We strive to keep careG available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by Service downtime.

10. Termination

We reserve the right to suspend or terminate your access to careG at any time, with or without cause, with or without notice. You may request deletion of your account at any time by contacting us at michael@pivit.tech. Upon termination, your data will be deleted within 30 days.

11. Limitation of Liability

To the maximum extent permitted by law, careG shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or any harm resulting from reliance on information stored in careG. Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid for the Service in the preceding 12 months.

12. Disclaimer of Warranties

careG is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page with a revised date. Your continued use of careG after changes constitutes acceptance of the updated Terms.
